Even though the law offers some level of protection for car owners, automotive car dealers don’t make the process easy. You could be dealing with a big dealership that is under the umbrella of a global car manufacturer. It should be noted that the express written warranty is not the only thing that is important in a lemon law case. Products that are sold can be categorized as “implied warranty” under common law. Lemon Law Protections  

In order for lemon law to be applicable, you must prove that the car was experiencing problems while still under warranty. Federal law stipulates that the manufacturer needs to be given reasonable time to fix the problem before you can have the car brought back. The law will require that:

  • The car has been out of service for more than 30 years.  
  • The problems with the car begun in the first two years of ownership

The law is not clear on the number of repairs that are deemed reasonable. If it goes to court, three or four times is usually seen as a reasonable number.  

Keeping Records  

You need to keep detailed records of the problems with the care once you start experiencing them. This is done in order to demonstrate to the court that the dealer or the manufacturer had more than enough time to fix the problem but still failed to do so. In order to improve the chances of winning, you will need to ensure that all repairs are filed in the correct way with all the details of the problems you’re experiencing with the car.  

Writing the Letter  

Once you’ve established that your car meets all the necessary criteria to be termed a lemon, you will need to write a letter to the manufacturer with all the facts letting them know that a refund is in order. The letter should include a timeline of when you bought the car and when you started experiencing the problems. The letter should be sent via certified mail to ensure that is delivered to the manufacturer.  


Most car manufacturers want to limit liabilities when they’re selling cars. That is why you should go through the documents you sign at the dealership. A car dealer might require that you go through an arbitrator when there is a dispute to be solved. There are some states that will require that you use the Better Business Bureau Auto Line before you can file a lawsuit. Even if you’re going through the arbitration process, it doesn’t hurt to have a lawyer involved to ensure you’re getting the best deal out of the situation.  


You should research your car and ask the manufacturer for Customer Satisfaction Campaigns and Technical Service Bulletins. You will have a stronger case if the problems you’re experiencing are not unique to you alone. The challenge will be in identifying a pattern. Car manufacturers have employed people to specifically deal with lemon law cases. It only makes sense to also look for an experienced attorney who is conversant with dealing with lemon law cases. You will likely improve the chances of winning the lemon law case if you have an experienced California lemon lawyer by your side. Choosing the right lawyer can be a daunting task. They are some pointers that could help in choosing the right candidate for the job.  

Experience: Make sure you’re looking for someone who is specialized in handling lemon law cases. You need someone who will be able to navigate the complexities of lemon law cases and is well aware of the due processes. It is important that you find a lawyer who has a track record of winning cases. Doing so will ensure that the case is handled well thus improving the chances of winning. 

Local: You should look for a local attorney as they will be in the best position to understand the local lemon laws. Make sure you meet in person with the lemon attorney before the beginning of the case. You should be wary if a law firm doesn’t want to meet the lawyer representing you in the lemon law case.
